At Luxify Transportation our priority is to provide outstanding customer service and the best ride experience. That is why we have set up the email customerservice@luxifytransportation.com to receive from our clients all special requests, complaints or suggestions they may have. Additionally, find below the terms and conditions of our service.

Terms & Conditions

By accessing and browsing the Site and/or placing a reservation with ACTM LLC, doing business as Luxify Transportation (“the Company), you accept, without limitation or qualification, these Terms and Conditions unless a corporate contract is in place which shall supersede the below.
 

General Terms

  1. The Company reserves the right to refuse service to anyone.
  2. We are not responsible for service delays caused by factors beyond our control, such as traffic congestion, road conditions, vehicular malfunctions, or weather.
  3. Chauffeurs may cancel the ride without refund if they feel threatened or detect potential danger to themselves or other passengers.
  4. Valuables left in our vehicles are the sole responsibility of their owners.
  5. All items brought into the vehicle are at the discretion of their rightful owners.
  6. We strictly enforce governmental regulations on drug and alcohol use. Open containers of alcohol are prohibited in our vehicles as per Florida Law.
  7. Riders will be responsible for all costs resulting from fines or legal fees if law enforcement discovers an open container in the vehicle.
  8. Immediate termination of services with no refund will occur if illegal drugs are used. Customers will be responsible for any fines incurred.
  9. Standing through the sunroof is illegal.
  10. Smoking of any kind is strictly prohibited in our vehicles.
  11. We are not liable for injuries resulting from physical altercations between passengers.
  12. We are not responsible for injuries due to intoxication.
  13. Chauffeurs cannot exceed the maximum passenger capacity, as it violates state law and our insurance guidelines.
  14. Additional surcharges may apply during holidays, celebrations, and observances.
  15. The company is not liable for mechanical breakdowns during charter rides and will only compensate for lost time at a mutually agreed date.
  16. The company will not be liable for any financial losses beyond the service provided due to delays caused by accidents, mechanical failures, Acts of God, traffic, etc. Complaints must be made within five business days after the event.
  17. The company will collect and retain all riders’ credit card information for damages or additional add-on time, billed to the individual who made the reservation.
  18. Riders are responsible for any costs incurred due to delays or damage to the vehicle caused by their actions.

 

Reservation and Payment Terms

Upon booking, a 25% non-refundable fee is applicable as a deposit to reserve the dates, and the remaining balance is billed within 7 days of the service.

Cancellations

Cancellations within 48 hours of the service are non-refundable, and will incur the full reservation amount charge. To cancel, contact reservations@luxifytransportation.com or call (239) 367-6448.

Hourly Billing

Billing commences at the scheduled pick-up time or when the driver arrives (whichever is later), and charges apply for the reserved minimum time (3 hours) or the actual usage, whichever is greater. Rides that exceed the scheduled drop off time by 15 minutes or more will be billed for an additional full hour of service. 

Waiting Period

Our rides are scheduled tightly. However, We normally have a waiting period of at least 15 minutes, after which the driver reserves the right to leave if passenger fails to show at the designated location or contact the driver. In this case, the total cost of the service will be charged plus the waiting time elapsed from the scheduled pickup time or when the driver arrives (whichever is later). If you cannot locate your driver, please call (239) 601-3960 to avoid waiting period billing.

Flight Delay and Cancellations

In case of a flight delay with the same flight number, the Company’s drivers monitor the flight status and adjust their arrival accordingly. While we make every effort to be there when you land, in the event of a significant delay, we request your flexibility. If the delay exceeds one hour, your driver may be slightly delayed, especially if we need to switch vehicles and drivers to accommodate our next scheduled reservation. We appreciate your understanding in such situations. For commercial flight delays with the same flight number as originally booked, the Company will not charge any additional fees. 

In case of cancellation of a commercial flight there will be no extra charges, as long as you meet the following requirements:

  1. A new booking must be made at the time of cancellation.
  2. Cancellations must be confirmed as genuine cancellations, not just flight changes for convenience.
  3. Pickup locations must remain the same as originally booked, at the same airport.
  4. The drop-off location must also remain unchanged from the original booking.
  5. The new pickup time for the ride must fall within 24 hours of the originally scheduled pickup time.

 

Vehicle Substitution

Luxify Transportation reserves the right to replace vehicles with those of equal or greater value based on availability during the transfer.

Fees for Cleanup/Damages

Luxify Transportation may charge cleanup and/or damages fees if liquid or food residue is found inside the vehicle post-charter, with a minimum cleanup fee of $75. Damages to the interior or exterior result in a fee based on restoration costs plus a 50% service fee. Full hourly or daily fees will be charged for any time the vehicle is out of service.

Payment Disclaimer

For all reservations we require full major credit card information including CCV number (security code), expiration date & billing address. Credit card is our ONLY, primary, and default form of payment. We do not accept cash or check. The billable party agrees that charges made in accordance with these Terms & Conditions of Service can not be disputed and agrees to be held responsible for any amounts due regardless of a card dispute resolution. *NOTICE: If you intend on utilizing our services with a credit card that does not belong to you, this is considered fraud. In the event of a fraudulent transaction, vehicle video footage, GPS telematics information, and any phone or electronic correspondences will be shared with local jurisdiction police and the FBI Fraud Unit. The passenger will not only be responsible for the amount due but also potentially criminal charges.*

If legal action is necessary to collect monies due, you will be responsible for all court costs, our attorney fees and the balance due. If a collection agency is used, you are responsible for recovery fees

 

Hold Harmless

The Client shall indemnify, defend and hold harmless Luxify Transportation against any and all claims, actions, damages, liabilities and expenses in connection with loss of life, personal injury and/or damage to or destruction of property arising from or out of any occurrence relating to the agreement between the client and Luxify Transportation and or the performance thereof.
